我想要把房子从两个人的名字转成一个人的名字。

当一个人准备撤除另一个人的名字 (房屋的拥有权),
又或者加上另外一個人的名字,
在法律上被视为房屋的股权转让 ,
必须另外签署合约,
支付律师费与产业转名印花税,
这是无法避免的程序与开销。

联名拥有的房屋,
在房屋贷款分期还没有缴清的状况下,

地契已被抵押给银行,
联名业主都必须征求银行的同意才能进行转让。

不管是业主以及借贷人的名字出现更动 (又或者借贷人的名字没有更动),
任何转让都会间接影响银行的利益。

如果业主擅自转名,
银行便无法审核更动后的业主或者贷款人的经济条件,
也更无法确定更动后的业主以及贷款人能否负荷贷款分期,
从而导致拖欠贷款的风险提高。

如果说更动后的业主或借贷人真的无法偿还贷款,
而且当初签的贷款/抵押合同跟现在的情况有所出入,
随之而来的是银行不能根据当初签署的合同履行拍卖的权力,
从而导致银行无法拍卖该产业。


为了防止上述事件发生,
银行通常会要求业主重新进行翻借(refinance),
并重新审核业主经济背景,
重新签署一份新的贷款/抵押合同,
再进行重新融资手续 ,
即解除上任贷款人的法律责任,缴交印花税,重新登记抵押手续等等。

只有在少数的情况下,
一些银行不会要求重新翻借,
进行transfer subject to charge,
即业主只要签署一些担保以及声明书,不需重新签署合同进行翻借手续。

在办理转名手续,
律师费跟印花税将根据房产的市场价值(market rate) 以及涉及的股份 (undivided share)来征收。

房产的市场价将根据JPPH,
即国家估价局的估价为准。

业主可根据门牌税(cukai harta/cukai pintu)上的估价(nilaian),估计所需费用。
但是这个门牌税的估价并不可靠,因为市政局可能长时间没有更新该屋价,导致低估房价。

另外涉及血缘关系,比如夫妻,父母,孩子关系将享有印花税减免 (外籍人士除外)。
如果在不涉及金钱的交易下完成手续,通常称为 transfer by way of love and affection/kasih sayang.

*兄弟姐妹关系不适用。
